Currently, there are thousands of lawsuits alleging that company websites are not accessible to the blind or visually impaired. Non-compliant websites are in violation of Title III of the ADA (Americans with Disabilities Act), which prohibits discrimination on the basis of disability in “places of public accommodation.” 42 U.S.C. § 12182(a). 

ADA lawsuits previously targeted businesses that did not provide physical access to Americans with disabilities. But, the new and current lawsuits make well-founded allegations that:

  1. Private company websites qualify as places of public accommodation;
  2. Websites with access barriers (e.g., websites without compatible screen-reading software, text altering software, etc.), deny plaintiffs their right to equal access.

Lawyers, on behalf of their clients, are also challenging the accessibility of mobile applications.

We agree with ADA compliance for websites. We believe that everyone should have equal access to everything on the internet. However, we also believe that the manner in which these lawsuits are being handled is unscrupulous, unfair and wrong. Businesses are being blindsided and sued without notice and without remedy except to settle or litigate – both costing many thousands of dollars.
